PRIVACY POLICY

Sneakzmarket GmbH, a limited liability company, Mühlenstrasse 40, 8200 Schaffhausen (hereinafter referred to as «Sneakzmarket») operates the online platform sneakzmarket.ch and the services offered through it. As such, it is responsible for the collection, processing, and use of your personal data and for ensuring that data processing complies with applicable data protection law.

Your trust matters to us, which is why we take data protection seriously and maintain appropriate security standards. We naturally comply with the legal provisions of the Federal Act on Data Protection (FADP), the Ordinance to the Federal Act on Data Protection (OFADP), the Telecommunications Act (TCA), and other applicable data protection regulations under Swiss or EU law, in particular the General Data Protection Regulation (GDPR). Please read the following information to learn what personal data we collect about you and for what purposes we use it.

Data Protection Officer

The party responsible for data processing on our website is:

Sneakzmarket GmbH

Email: kontakt@sneakzmarket.ch

Visiting Our Website

When you visit our website, our servers temporarily log each access in a log file. The following technical data is collected automatically — as is always the case with any connection to a web server — without any action on your part, and is stored until automated or manual deletion no later than 12 months: the IP address of the requesting computer, the name of the owner of the IP address range (typically your internet service provider), the date and time of access, the website from which access was made (referrer URL), where applicable including the search term used, the name and URL of the retrieved file, the status code (e.g. error message), the operating system of your computer, the browser you are using (type, version, and language), and the transfer protocol used (e.g. HTTP/1.1).

You can visit our website without providing any personal data. We only store access data in the so-called server log file, such as the name of the file, the date and time of your visit, the amount of data transferred, and the requesting provider. This information is used solely to ensure the smooth operation of the site and to improve our offerings, without being able to link the data to you personally.

Cookies

Cookies help make your visit to our website easier, more enjoyable, and more meaningful in many ways. Cookies are information files that your web browser automatically saves to your computer's hard drive when you visit our website. For example, we use cookies to provide you with the shopping cart function across multiple pages and to temporarily save your entries when you fill out a form on the website, so you don't have to re-enter information when you navigate to another page. Cookies can also be used to identify you as a registered user after you have registered on the website, so you don't need to log in again when accessing a different sub-page. Most internet browsers accept cookies automatically. However, you can configure your browser to prevent cookies from being stored on your computer, or to always display a notification when you receive a new cookie.

Data Storage

We store personal data only for as long as is necessary for the use of the tracking and analytics services mentioned above, as well as for any further processing within the scope of our legitimate interests. Contract-related data is retained for longer periods, as required by statutory retention obligations.

We collect personal data when you voluntarily provide your contact details, when you get in touch with us (e.g. via our contact form or by email), or when you create a customer account. The data collected in each case can be seen in the respective input forms. We use the data you share with us to process your orders and respond to your enquiries. Once a contract has been completed or your customer account has been deleted, your data will be blocked and deleted upon expiry of the applicable tax and legal retention periods, unless you have consented to the further use of your data or we hold lawful authorisation to use certain data, of which you will be informed. You may delete your customer account at any time by sending a message to the contact details provided below, or by using the relevant function in your customer account settings.

Sharing Data with Third Parties

We only share your personal data if you have expressly consented to a legal obligation to do so, or if this is necessary to enforce our rights, in particular to enforce claims arising from the contractual relationship. In addition, we share your data with third parties to the extent required for the operation of the website and the fulfilment of contracts (including outside the website), i.e. the processing of your order. This includes the respective payment service provider. The website is hosted on servers around the world. Data transmission serves the purpose of providing and maintaining the functionality of our website. This constitutes our legitimate interest within the meaning of Art. 6(1)(f) of the EU GDPR.

With regard to the processing of your credit card information by these third parties, we also ask you to read the terms and conditions and the privacy policies of your credit card issuer.

Our website uses services provided by Shopify. Your data will be shared with these providers where necessary. The purpose and scope of data collection and its further processing and use by the providers, as well as your related rights and options for protecting your privacy, can be found in the providers' privacy notices.

Transfer of Data Abroad

We are also entitled to transfer your personal data to third parties (contracted service providers) abroad for the purposes of data processing described in this privacy policy. These parties are bound by the same data protection obligations as we are. We may transfer your personal data to recipients abroad, including countries that do not guarantee a level of data protection equivalent to that provided under Swiss law.

Use of Payment Service Providers

We process payments via PayPal, PayPal Pte. Ltd., 5 Temasek Boulevard, #09-01 Suntec Tower Five, Singapore 038985, Singapore, Concardis, Nets Schweiz AG, Richtistrasse 17, 8304 Wallisellen, Switzerland (CHE-112.885.197), or Klarna, Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm.

Google Analytics

Our website uses Google Analytics, a service provided by Google LLC, USA, which monitors and records how our website is used. Google Analytics uses cookies, i.e. text files stored locally on your computer, to analyse how our website is being used. The information generated by these cookies about your use of our website is generally transmitted to and stored on a Google server in the USA. This information is held in aggregated form and cannot be used to identify any individual. Google Analytics is implemented using anonymised IP addresses, which are truncated within the EU/EEA. Google is subject to both the CH-US and EU-US Privacy Shield frameworks.

Use of Social Media

Our website uses so-called social plugins, in particular those from Facebook and Google+, as well as the microblogging services of Twitter and Instagram. These services are provided by Facebook Inc., Google Inc., Twitter Inc., and Instagram LLC (providers). When you visit one of our web pages that contains a plugin, your browser establishes a direct connection to the servers of Facebook, Google, Twitter, or Instagram. The content of the plugin is transmitted directly from the respective provider to your browser and integrated into the page. By embedding the plugin, information is transmitted to the provider indicating that your browser has accessed our website, even if you do not have a profile with the provider or are not logged in. The purpose and scope of data collection and its further processing and use by the providers, as well as your related rights and options for protecting your privacy, can be found in the providers' privacy notices.

Data Security

We employ appropriate technical and organisational security measures to protect your stored personal data against manipulation, partial or complete loss, and unauthorised access by third parties. Our security measures are continuously updated in line with technological developments. You should always keep your login credentials confidential and close your browser window when you have finished communicating with us, especially if you share your computer with others. We also take corporate privacy very seriously.

Klarna

"In order to offer you Klarna's payment methods, we may pass on your personal data in the form of contact and order details to Klarna during the checkout process, so that Klarna can assess whether you are eligible for their payment methods and tailor the payment options to you. Your transmitted personal data will be processed in accordance with the Klarna Privacy Policy."

"Billpay/Klarna payment options: In order to offer you Klarna's payment options and to assess whether you are eligible for them and to tailor the payment options to you, we may pass on your personal data in the form of contact and order details to Klarna and Billpay during the checkout process. Your personal data will be processed in accordance with applicable data protection laws and in line with the information set out in the privacy policies of Klarna [de, fr, it or en versions] and Billpay [de, fr, it or en versions]."

Your Rights

You have the right to request information about the personal data we hold about you. In addition, you have the right to have inaccurate data corrected and the right to have your personal data deleted, provided there is no statutory retention obligation or authorisation requirement that permits us to continue processing the data. You also have the right to lodge a complaint with a data protection supervisory authority at any time.

Furthermore, we reserve the right to store your first and last name and address — where shared by you during the order process — along with your title, academic status, or year of birth in a consolidated list, and to use this data for personalised marketing purposes, such as sending special offers or informational brochures about our products (e.g. newsletters). You have the right to object to the storage and use of your data for this purpose at any time by contacting us at: kontakt@sneakzmarket.ch .
