I. Scope and purpose 

1. The following general terms and conditions (hereinafter referred to as "GTC") serve as the legal basis for the duration of the contractual relationship between Sneakzmarket GmbH, limited liability company, Mühlenstrasse 40, 8200 Schaffhausen (hereinafter referred to as "Sneakzmarket") and the customer. The GTC in their current version apply to the entire business area of ​​Sneakzmarket and to all legal transactions concluded via the Sneakzmarket online shop (sneakzmarket.ch) (hereinafter referred to as "online shop"), subject to a separate agreement. 
2. Sneakzmarket reserves the right to change these terms and conditions at any time. The version of these terms and conditions valid at the time of the order is decisive. The offer of products in the online shop (hereinafter referred to as "offer") is aimed exclusively at customers residing in Switzerland and Liechtenstein. 

 

II. Offers and conclusion of contract 

1. The range of products presented in the online shop does not constitute a legally binding offer. The product presentations on the Internet serve as a guide for customers and enable customers to submit an offer. In particular, they do not represent an obligation on the part of Sneakzmarket to sell and deliver the goods presented. 
2. Sneakzmarket expressly reserves the right to change, add to or delete parts of the pages or the entire offer without prior notice or to temporarily or permanently cease publication. 
3. If the customer places an order in the online shop, he or she makes a binding offer to conclude a purchase contract. The contract is only concluded when Sneakzmarket sends an order confirmation by email. 

 

III. Availability and delivery time

V. Delivery 

1. The customer has three delivery options: local pickup and postal delivery. The delivery method is selected during checkout. 
2. If the customer wishes to collect the order on site, he will be notified of the status and the possibility of collecting the order. If the customer does not collect the ordered products in the store (self-collection) within 7 calendar days of the notified date, Sneakzmarket can terminate (cancel) the contract. 
3. In the case of postal delivery, delivery will be made by Swiss Post to the address provided by the buyer. Packaging and shipping costs will be charged separately. The general terms and conditions of Swiss Post AG apply to delivery by Swiss Post. 
4. With the order confirmation, the customer will be informed of a provisional delivery date. The stated delivery times are without guarantee. Sneakzmarket will endeavour to dispatch the ordered goods as quickly as possible. 
5. Delivery will be made at the customer's expense and risk only after payment has been processed. 

 

VI. Payment 

1. Payments must be made in Swiss francs.
2. Accepted payment methods are Visa, Mastercard, Maestro, American Express, Apple Pay, Twint, Klarna and PayPal. The terms and conditions of PayPal Pte. Ltd., Apple Inc., Klarna Bank AB and Twint AG apply to payment processing through PayPal, Apple Pay, Klarna and Twint. 
3. The offsetting of claims by the customer is excluded.
4. In the event of non-compliance with the payment deadline, reminder fees may be charged incrementally. Additionally, a reasonable default interest will be applied. Additional administrative costs, to be borne by the end customer, will be charged if the matter is handed over to a collection agency.

Purchase by invoice with partial payment option (POWERPAY)

As an external payment provider, MF Group/POWERPAY offers the payment option ‘Pay by invoice’. You can simply pay for your online purchase by invoice using the order invoice. If you do not make the payment within the specified period, you will receive a subsequent monthly invoice the following month with an order overview.

VII. Cancellation/Return 

There is no general right to return or exchange. Returns as a gesture of goodwill, as well as subsequent changes or cancellations of the order, are solely at the discretion of Sneakzmarket. 

 

VIII. Customer's obligation to inspect 

1. Delivered or picked up products must be checked for accuracy, completeness and delivery damage immediately upon receipt. Any defects (visible or hidden) in the products must be reported to Sneakzmarket by the customer immediately, but no later than within 24 hours of receiving the products. Defects that were not apparent during the customer's immediate, proper inspection (hidden defects) must be reported immediately after they are discovered. 
2. In order to process a claim, the products must be kept in their original packaging and must not be used until Sneakzmarket contacts the customer. 
3. Sneakzmarket will notify the customer once the return has been received and inspected. Sneakzmarket will then decide whether the refund has been approved. If this is the case, the purchase price will be automatically transferred to the original payment method. Please note that it may take some time for the customer's bank or credit card company to process and post the refund. 

 

IX. Warranty 

1. Sneakzmarket guarantees that the ordered goods are free from defects for a period of 2 years. The period begins upon receipt of the ordered goods. During this period, all defects that are subject to the warranty will be remedied free of charge, provided that the customer notifies the defect in a timely manner. 
2. Sneakzmarket can provide the warranty either through partial or complete replacement with an equivalent product, credit up to a maximum of the sales price at the time of the order, or reduction. The warranty claim expires for damages resulting from improper handling and use of the goods. 
3. The warranty is explicitly excluded for products whose intrinsic quality (e.g. taste quality) does not meet the customer's requirements, as well as products ordered by mistake. 

 

X. Disclaimer 

1. Claims for damages arising from non-delivery or breach of contract are excluded. In particular, Sneakzmarket excludes any liability for minor and moderate negligence. Liability for any assistants called in is also excluded. 
2. Sneakzmarket also assumes no liability whatsoever with regard to the correctness, accuracy, timeliness, reliability and completeness of the information on the website. Liability claims against Sneakzmarket for material or immaterial damages resulting from access to, use of or non-use of the published information, misuse of the connection or technical faults are excluded. 
3. In the event of an error in the price announcement or the description of the goods, Sneakzmarket is not bound by the incorrect information. 

 

XI. Copyright 

The copyright and all other rights to content, images, photos or other files on this website belong exclusively to Sneakzmarket or the specifically named rights holders. The written consent of the copyright holder must be obtained in advance for the reproduction of any elements. In the event of a violation of this requirement, Sneakzmarket reserves the right to take all legal action. 

 

XII. Data Protection 

The protection of personal data is important to us. We therefore conduct our activities in accordance with the applicable legal provisions on the protection of personal data and data security. 

 

XIII. Deviations 

Deviations from these Terms and Conditions are only valid on the basis of a document confirmed by both parties and have no influence on the applicability of the remaining provisions. 

 

XIV. Final provisions, applicable law and place of jurisdiction 

1. This contractual relationship is subject exclusively to Swiss law. 
2. The exclusive place of jurisdiction for all disputes is Schaffhausen, unless there is a statutory place of jurisdiction. 
3. Should one of these clauses be declared invalid, the other provisions of the General Terms and Conditions shall remain unaffected. The invalid provisions shall be replaced by provisions that are as economically equivalent as possible and lawful.
